Terms of sale
A - Introduction
These conditions of sale (hereinafter only "General Conditions") govern the sale of products marketed by PLAST IDEA SRL, with registered office in Rome, Via dei Gordiani 22, registered in the Rome Companies Register with REA number: RM -795343 – CF and VAT number 04701091003, through the website www.plastidea.com . All product purchase contracts concluded through the site www.plastidea.com according to the procedures indicated therein, between the seller and the Customer, will be governed by these General Conditions.
The user may contact the Company to request any information, to send communications or to submit complaints, by writing to the email address info@plastidea.it or by contacting customer service at the telephone number: +39 06.25205085 - +39.06.25205110 or by writing to PLAST IDEA SRL.
All published prices are net sales prices, excluding VAT.
B - Acceptance of the conditions of sale
1. Access to the offers presented on the site www.plastidea.com is permitted exclusively to VAT holders. The Customer has the right to access the site for browsing and making purchases. No other use, particularly commercial, of the site or its content is permitted. All elements of this site, whether audio or visual, and the related technology used remain the property of PLAST IDEA and are protected by intellectual property rights. These general conditions are effective from the date of acceptance by the customer on the site, which constitutes acceptance pursuant to art. 1341 of the Italian Civil Code, and replace all other conditions, except for preliminary, express, written exceptions. The company reserves the right to modify these general conditions of sale at any time by posting them on the site.
2. To make purchases on the site www.plastidea.com The user must first register and provide his or her name, surname or company name and email address.
3. By placing an order using one of the various methods provided, the Customer declares that he or she has read all the information provided during the purchase procedure and fully accepts the General Conditions and Payment Terms set out below.
4. The Customer is excluded from any right to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.
C - Purchase methods
In accordance with Legislative Decree no. 70 of 9 April 2003, which contains provisions regarding electronic commerce, PLAST IDEA informs the user that:
1. Only products listed in the PLAST IDEA SRL electronic catalogue at the time of ordering and viewable online at (URL) http://www.plastidea.com can be purchased, as described in the relevant information sheets. It is understood that the image accompanying the product description may not be perfectly representative of its features but may differ from the actual product in terms of colour, size, and accessory products shown in the image due to the local settings of the systems and/or tools used to view them. All information supporting the purchase (technical data sheet, etc.) is intended as simple general information and does not refer to the actual characteristics of an individual product.
2. to conclude the purchase contract for one or more products on the site www.plastidea.com the user will have to fill out an order form in electronic format and send it electronically, following the instructions that will appear from time to time on the site www.plastidea.com and which will accompany the various phases of the purchase;
3. the contract is concluded when PLAST IDEA registers the order form (i.e. when the order form reaches the Company's server);
4. Before purchasing products and submitting the order form, the user will be asked to read and approve the General Conditions of Sale; the user may print a copy of the General Conditions of Sale and/or save them on a durable medium;
5. Before proceeding with the transmission of the order form, the user can identify and correct any data entry errors by following the instructions indicated from time to time on the site www.plastidea.com and which will accompany the various stages of the purchase; the customer undertakes to verify the accuracy of their data and those communicated.
6. The order form will be stored in the PLAST IDEA database for the time necessary to process the order and, in any case, within the terms of the law.
7. The products will remain the property of PLAST IDEA until the purchase price and any expenses have been paid.
8. The printing plates remain the exclusive property of the seller even if the customer contributes in whole or in part to the production costs.
9. on the site http:// www.plastidea.com Product availability is visible at the time of ordering. Since the simultaneous access of many users and the simultaneous possibility of online orders affect product availability, PLAST IDEA cannot guarantee the certainty of allocation of the ordered goods.
10. Any additional costs, charges, taxes and/or duties that a given country may apply, for any reason whatsoever, to the products ordered under this contract shall be the sole responsibility of the Customer.
11. For certain products subject to price promotions, PLAST IDEA reserves the right to accept orders by reducing the quantities, subject to prior communication and acceptance by the Customer, failing which the order will be considered cancelled.
D – Payments
a) All published prices are net sales prices, excluding VAT; PLAST IDEA reserves the right to change prices at any time without notice. Product prices may be changed without notice, but the price charged to you will be the price published on the product page at the time the order is placed.
b) Payments must be made by the due dates indicated in the order confirmation; payments are considered final only if made directly to Plast Idea Srl. Failure to pay even a single invoice constitutes a serious breach and authorizes the seller to suspend further deliveries or to immediately terminate the contract due to the buyer's breach, reserving the right to claim damages. Similarly, if the contract provides for a deferred payment option and the buyer fails to pay within the deadline or makes a complaint about a shipment already delivered, the seller will have the right to revoke this condition and request advance payment for subsequent deliveries. If the buyer fails to comply with this request, the seller may terminate the contract, reserving the right to claim damages.
c) in the event of staggered shipments of the products subject to an order or agreement, the invoices corresponding to the individual deliveries are payable on their respective due dates, without waiting for the delivery of all the products subject to the order or agreement.
d) In the event of late payments, the default interest rates set forth in Legislative Decree 231/02 will be applied without the need for formal notice or prior notice.
E – The orders
Purchase orders will be processed only after receiving confirmation of payment of the total amount due, consisting of the purchase price of the product(s) and any shipping costs. Before executing the contract, PLAST IDEA reserves the right to verify orders submitted by users to identify any attempts to circumvent the purchase ban, credit card fraud, or unusual purchases.
In particular, pursuant to art. 1456 of the Italian Civil Code, PLAST IDEA will have the right to terminate the contract and, consequently, to cancel the order and refund the user the total amount due, if:
• the order appears to come from a person who does not have the right to make purchases on the site www.plastidea.com ;
• the credit card used for payment is cloned or there is reasonable doubt that the purchase was not made by the card holder or if the credit card issuing company informs PLAST IDEA that the credit card has been blocked;
• the order sent by the user presents an anomalous nature in relation to the type and/or quantity of products purchased or to the frequency of purchases made on the site www.plastidea.com ;
• on the date of purchase the user is in breach of the obligations arising from or in any case connected to the execution of a previous contract concluded with PLAST IDEA.
F – Payment Methods
Payment for products purchased on the site www.plastidea.com it may occur in the following ways:
• Credit cards (Visa, Mastercard, Postepay);
• PayPal;
• Bank transfer;
1. Mark
Payment must be made to the courier in cash (exact amount, no change is available) or by bank check.
2. Advance Bank Transfer
If paying by advance bank transfer, your order will be shipped only after the payment has been credited to PLAST IDEA's account. This payment must occur within 3 business days of the order being accepted. After this time, the order is automatically cancelled. The reason for the bank transfer must include the order ID (order number and order date), which is provided in the order confirmation email.

3. Credit Card
- In the case of purchases of goods with a credit card payment method, at the same time as the online transaction is concluded, the relevant banking institution will authorize only the commitment of the amount relating to the purchase made.
- PLAST IDEA reserves the right to request additional information from the Customer (e.g., telephone number) or copies of documents proving ownership of the Card used. In the absence of the requested documentation, PLAST IDEA reserves the right to refuse the order.
At no point during the purchase process will PLAST IDEA be able to access the buyer's credit card information, which is transmitted via a secure connection directly to the website of the banking institution handling the transaction. PLAST IDEA Wholesale does not store this data in its computer archives. Therefore, under no circumstances can PLAST IDEA be held responsible for any fraudulent or improper use of credit cards by third parties when paying for purchased products.
H - Delivery methods
No changes to the invoice will be possible after it has been issued.
Goods are shipped within 2-3 days of receiving the order, via national courier.
Deliveries will be made by express courier from Monday to Friday, during normal office hours, excluding national holidays. Products will be delivered to the postal address specified by the user on the order form.
PLAST IDEA will do its best to meet delivery deadlines, which, however, are not binding.
Any delays cannot constitute a right of recourse, nor do they give rise to the right to cancel or reduce the order, nor, in any case, to compensation for damages. If the products are not collected on the scheduled date, PLAST IDEA may request payment of storage costs in addition to the price for the products.
In any case, the Customer will not have the right to withhold any sums due to PLAST IDEA for any reason and/or to delay and/or not make payments for the supply due to reported defects and/or faults even if recognised by PLAST IDEA and/or to offset any debts of PLAST IDEA with credits claimed by the same for any reason and/or cause whatsoever.
The goods travel at the customer's risk, even if sold carriage paid. The seller guarantees effective packaging and is not liable for any tampering by the carrier or third parties.
Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to that indicated on the invoice;
- that the packaging is intact, not damaged, not wet or, in any case, altered;
PLAST IDEA may, for reasons relating to the supply, deliver a quantity 15% lower or higher than that ordered for unit measurements and 20% higher for total quantity and weight. A color tolerance is also permitted, without this constituting a breach of contract or entitling the Customer to request a price change.
Any damage to the product or packaging, or any discrepancies in the information provided, must be immediately reported to the courier by writing "Subject to Inspection" on the courier's delivery receipt. Once the courier's delivery receipt has been signed, the customer will no longer be able to raise any objections regarding the external appearance of the goods delivered.
If the customer fails to collect the goods stored at the courier's warehouse within 5 days due to repeated failure to deliver to the address indicated when placing the order, the order will be cancelled and the customer will be charged for all storage and shipping costs.
Even if the packaging is intact, the goods must be inspected within eight days of receipt. Any hidden damage or anomalies must be reported in writing by registered mail with return receipt to Plast Idea Srl, whose address is specified on the accompanying document.
Any reports received after the aforementioned deadlines will not be considered. For each declaration, the Customer assumes full responsibility for the information provided.
I – Guarantees provided by the customer and assumption of responsibility
1. The Customer guarantees, assuming all inherent responsibility and holding PLAST IDEA harmless from any prejudicial consequences, that his/her data, provided upon acceptance of these general conditions, are truthful and allow the true identity of the Customer to be identified. The Customer also undertakes to inform PLAST IDEA immediately and in writing of any changes to the data provided.
2. The availability of each item is indicative only, has no contractual nature and the seller cannot be held responsible in the event of unavailability of one or more products.
L – Intellectual Property, Brand Protection
The brands distributed by www.plastidea.com are protected by applicable laws and international conventions. The Customer is solely responsible for the trademarks, distinctive signs, names, and graphic representations they request to be placed on the products and expressly guarantees to PLAST IDEA that they are the owner or can legally use them and that their use does not violate any third-party rights.
Neither Customers nor third parties may use the logos of the aforementioned brands without prior written consent from the trademark owners; acceptance of the General Conditions does not imply such an agreement under any circumstances. The Customer undertakes not to perform any act incompatible with ownership of the Intellectual Property Rights.
Use of trademarks without the owner's authorization is the sole responsibility of the user. In any case, the Customer indemnifies PLAST IDEA from any claims it may receive from the alleged owner of the trademarks, distinctive signs, names, and graphic representations affixed by PLAST IDEA to the products at the Customer's request, as well as from refunding all costs PLAST IDEA may incur due to third-party disputes.
M – Privacy
The personal data requested during order placement is collected by PLAST IDEA and processed electronically in order to fulfill the obligations arising from the contract concluded with the Customer and will not be disclosed to third parties under any circumstances or for any reason. PLAST IDEA guarantees its customers compliance with the legislation regarding the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree No. 196 of June 30, 2003. The data controller is PLAST IDEA, represented by its legal representative from time to time, unless a data controller is appointed pursuant to art. 29 of Legislative Decree No. 196/2003.
The customer has the right to withdraw consent to the processing of personal data at any time by sending a written communication to PLAST IDEA's registered office. The customer, who declares having received the information pursuant to Article 13 and the rights granted to them pursuant to Article 7 of Legislative Decree no. 196/2003, has the right to access their data according to the methods set forth therein.

N – Force Majeure
PLAST IDEA will make every effort to fulfill all obligations undertaken under this contract. PLAST IDEA assumes no liability for disruptions due to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions or disruptions, in the event that it is unable to fulfill the order within the timeframe stipulated in the contract.
In any case, PLAST IDEA will be exempt from any liability for delays or failures caused by circumstances beyond its control. In the event of a delay, PLAST IDEA will perform its obligations as soon as reasonably possible.
O – Transfer
The Parties may not assign or otherwise transfer to third parties any of their rights and obligations arising from this Agreement without the prior written consent of the other Party.
P – Retention of title
1. In dealings with commercial customers, all delivered goods remain our property (retention of title) until all obligations arising from the business relationship with the respective purchaser have been fulfilled, even if payments for specific claims have been made. In dealings with non-commercial customers (consumers), we retain title to the delivered goods until the respective purchase price has been paid.
2. The buyer is authorized to use and sell the goods subject to retention of title in the normal course of business, provided there are no defaults on our part. The buyer is authorized to resell or use the goods subject to retention of title only if the claims arising from the resale or use are assigned to us in accordance with sections 3–5. The buyer is not authorized to dispose of the goods subject to retention of title in any other way.
3. The buyer shall immediately assign to us all claims arising from the resale and/or use of the goods subject to retention of title, regardless of whether such goods have been sold to one or more customers or are used for one or more clients.
4. The buyer is authorized to collect the claims assigned to us arising from the resale or use of the goods until revoked by us, which we may exercise at any time. Upon maturity of the claims against us, the buyer shall be obligated to immediately transfer the collected amounts to us. Under no circumstances shall the buyer be entitled to assign such claims to third parties.
5. Upon our request, the buyer shall be obliged, unless we do so ourselves, to immediately notify the customer of the assignment of his claim to us and to confirm such notification to us, as well as to forward to us the information and documents necessary for the collection of such assigned claims with the corresponding notification.
6. The buyer is obliged to notify us immediately of any seizures or any other cases in which our rights are affected by the actions of third parties.
7. In the event that the security arising from the retention of title exceeds the credit to be secured by more than 20%, we shall be obliged to release the security at our discretion upon request of the purchaser.
8. The buyer's collection authorization will be revoked if the payment terms are not respected, if the buyer violates the contractual terms or conditions, in the event of cessation of payments by the buyer or the commencement of preventive composition proceedings or bankruptcy proceedings.
Q - Complaints
Any complaints must be sent by registered mail to PLAST IDEA SRL, Via dei Gordiani, 22, Rome (RM) no later than eight days after receiving the goods. Returns will not be accepted unless carriage paid and authorized in writing by PLAST IDEA. The Customer must allow PLAST IDEA to inspect the allegedly defective products.
R – Jurisdiction and Applicable Law
The sales contract between the Customer and PLAST IDEA SRL is deemed to have been concluded in Italy and is governed by Italian law. In the event that any dispute arising from the execution, interpretation, or application of this contract, or any dispute concerning the validity and effectiveness of this contract between one or more Customers on the one hand and PLAST IDEA SRL on the other, cannot be resolved by mutual agreement, such dispute will be subject to the exclusive jurisdiction of the Court of Rome.
S - Conditions
